These Terms of Use ("Terms") constitute a legal agreement between you and Cam Frederick ("Developer," "we," "us," or "our") governing your use of the TouchLine mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms incorporate Apple's Licensed Application End User License Agreement (EULA). In the event of a conflict between these Terms and Apple's standard EULA, Apple's EULA shall control.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes. This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App.

2. Restrictions

You agree that you will not:

  • Copy, modify, or create derivative works of the App or any portion thereof
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Remove or alter any proprietary notices or labels on the App
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Use the App to infringe the intellectual property rights of any third party
  • Attempt to gain unauthorized access to any systems or networks connected to the App

3. Subscriptions and In-App Purchases

Subscription tiers. TouchLine offers optional premium subscriptions ("Premium") that unlock additional features beyond the free tier. Subscription options and current pricing are displayed within the App at the time of purchase.

Introductory offers. We may offer introductory pricing or free trials for new subscribers. Introductory offers are available only to users who have not previously subscribed to that subscription tier. At the end of any introductory period, your subscription will automatically renew at the standard rate unless cancelled.

Billing. Subscriptions are billed through your Apple ID. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Cancellation. You may cancel your subscription at any time through your Apple ID account settings in the App Store. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the period you have paid for expires.

Refunds. All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with Apple's refund policies. We do not process refunds directly.

Free tier. The App is available at no charge with a limited feature set. We reserve the right to modify the features included in the free tier at any time.

Price changes. We may change subscription prices at any time. Price changes will be communicated through the App Store and will take effect at the start of your next renewal period after Apple notifies you. Continued use of a subscription after a price change takes effect constitutes acceptance of the new price.

4. App Updates and Changes

We may release updates to the App from time to time to add features, fix bugs, or improve performance. We reserve the right to modify, suspend, or discontinue any feature or aspect of the App at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App or any features thereof.

5. Your Content

All plays, formations, team sheets, player data, and other content you create within the App ("Your Content") remains yours. We make no claim to ownership of Your Content. You are solely responsible for Your Content and for ensuring you have the rights to any content you import into the App, including video clips.

Because all data is stored locally on your device, we have no access to Your Content and cannot recover it on your behalf. You are responsible for maintaining backups of any content you wish to preserve. We are not liable for any loss of Your Content due to device failure, accidental deletion, or use of the "Clear All Data" feature.

6. Intellectual Property

The App, including its design, code, graphics, and all other content provided by us, is owned by Cam Frederick and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you. The TouchLine name, logo, and all related marks are proprietary to Cam Frederick.

7. Third-Party Services

The App integrates with Apple services including the App Store, StoreKit, and Apple's MultipeerConnectivity framework. Your use of these services is governed by Apple's terms and policies. We are not responsible for the practices of Apple or any other third-party service provider.

8. Export Compliance

The App may be subject to United States export laws and regulations. You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK. THE APP IS NOT INTENDED FOR USE IN SITUATIONS WHERE ERRORS OR INACCURACIES COULD LEAD TO HARM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAM FREDERICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cam Frederick from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another party.

12. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any provision. Upon termination, you must cease all use of the App and delete all copies from your devices. We may also terminate or suspend your access to the App at any time, for any reason, without notice. Sections that by their nature should survive termination (including but not limited to Sections 6, 9, 10, 11, and 13) shall survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts. Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

14. Assignment

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice to you, including in connection with a merger, acquisition, or sale of assets. Any assignment in violation of this section is void.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Apple's standard EULA, constitute the entire agreement between you and Cam Frederick with respect to the App, and supersede all prior or contemporaneous agreements and understandings relating to the App.
